Terms & Conditions
1. Scope and Contracting Party
These Terms & Conditions apply to all orders placed through the online store operated by:
Zackarias Hillberg
HILLBERG STUDIO DESIGN
Grangasse 1/32
1150 Vienna
Austria
Email: concierge@hillbergdesign.com
2. Products
The online store offers, in particular, original artworks, limited art prints, hand-painted cards and handcrafted art and design products.
Due to the handmade or artistic nature of certain products, minor variations in colour, texture or finish may occur. Statutory warranty rights remain unaffected.
For commissioned works and individually made products, the specifications, design and delivery times agreed for the respective order apply.
3. Conclusion of the Contract
The presentation of products in the online store does not constitute a binding offer to enter into a contract.
By completing the checkout process and clicking the respective order button, the customer submits a binding offer to purchase the products contained in the shopping cart.
The contract is concluded when we confirm acceptance of the order by email.
Before submitting an order, customers can review and correct the information entered during the checkout process.
The order details are stored within the shop system and are provided to the customer by email after the order has been placed.
The contract language is English.
4. Prices and Shipping Costs
All prices displayed in the online store include the applicable statutory VAT.
Any additional shipping costs are shown separately before the order is placed.
For deliveries outside the European Union, import duties, customs duties, taxes or other charges may be imposed by the destination country. Such charges are not included in the purchase price charged by us and are borne by the recipient, unless otherwise required by law.
5. Payment
The payment methods currently available at checkout include:
-
credit and debit cards
-
Apple Pay
-
Google Pay
-
advance payment by bank transfer
Payments made by credit or debit card, Apple Pay or Google Pay are processed through Wix Payments.
For advance payment by bank transfer, the payment instructions and bank details are provided during the checkout process. The order will be processed after the payment has been received.
Payment is made in accordance with the payment method selected during checkout.
6. Delivery and Shipping
We generally ship worldwide, provided that the respective destination country is available for selection during checkout and there are no legal or practical restrictions preventing delivery.
For deliveries within the European Union, the estimated delivery time is generally 7-10 business days, unless a different delivery time is specified for the respective product.
For deliveries outside the European Union, the estimated delivery time is generally 10–20 business days, unless a different delivery time is specified for the respective product.
Actual delivery times may also be affected by customs clearance, the destination country and local delivery services.
For commissioned works and individually made products, the delivery time specified for the respective product or agreed in the individual offer applies.
Orders are currently shipped via Österreichische Post AG (Austrian Post).
7. Retention of Title
The goods remain our property until the purchase price has been paid in full.
8. Right of Withdrawal
Right of Withdrawal
Consumers have the right to withdraw from a distance contract within 14 days without giving any reason.
The withdrawal period is 14 days from the day on which the consumer, or a third party designated by the consumer other than the carrier, takes possession of the goods.
Where multiple goods ordered as part of a single order are delivered separately, the withdrawal period begins on the day on which the consumer, or a third party designated by the consumer other than the carrier, takes possession of the last item.
Exercising the Right of Withdrawal
To exercise the right of withdrawal, the consumer must inform us of their decision to withdraw from the contract by means of a clear statement, for example by email, addressed to:
Zackarias Hillberg
HILLBERG STUDIO DESIGN
Grangasse 1/32
1150 Vienna
Austria
Email: concierge@hillbergdesign.com
To meet the withdrawal deadline, it is sufficient for the consumer to send the notification of withdrawal before the withdrawal period has expired.
Consumers may use our Model Withdrawal Form, although use of the form is not mandatory.
For contracts concluded online, the consumer may also exercise the right of withdrawal using the online withdrawal function provided on this website.
Effects of Withdrawal
If a consumer withdraws from the contract, we will reimburse all payments received from the consumer, including the cost of the least expensive standard delivery method offered by us.
Any additional costs resulting from the consumer choosing a delivery method other than the least expensive standard delivery method offered by us will not be reimbursed.
Reimbursement will be made without undue delay and no later than 14 days after the day on which we receive notification of the withdrawal.
Unless expressly agreed otherwise, reimbursement will be made using the same means of payment used for the original transaction.
We may withhold reimbursement until we have received the goods back or until the consumer has provided evidence that the goods have been returned, whichever occurs first.
Return of Goods
The goods must be returned without undue delay and no later than 14 days after the consumer has notified us of the withdrawal.
The consumer bears the direct cost of returning the goods.
For goods which, by their nature, cannot normally be returned by post, the estimated direct cost of return will be provided before the order is placed.
The consumer is liable only for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
Exclusion of the Right of Withdrawal for Custom-Made Products
The right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalised to the consumer’s individual requirements.
This may apply, in particular, to commissioned artworks individually created in accordance with the customer’s specifications, provided that the statutory requirements for the exclusion of the right of withdrawal are met.
9. Statutory Warranty
Statutory warranty rights apply.
These Terms & Conditions do not restrict or exclude any mandatory statutory warranty rights available to consumers.
10. Liability
Statutory liability provisions apply.
Nothing in these Terms & Conditions limits or excludes any mandatory liability rights available to consumers.
11. Governing Law
These Terms & Conditions are governed by Austrian law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence.
